Having gone thru this same issue with an insane ex here is what worked for me.
Get in touch with the mortgage copany that holds the note and let them know the issue at hand. Usually, they can accept a check from her and a check from him. This will at least keep her credit somewhat solid.
If he refuses to make any payments on the house once this suitation is worked out, then have his mail redirected elsewhere, have the locks changed, security codes changed (if any). He has vacated the premises and refuses to acknowledge his obligation.
Talk again to same mortgage company about having his name removed from the loan since he has vanished and you have no contact with the person. Not sure the process there.
How involved in her life is this guy?....does he still come by, etc?
Talk to the mortgage company most importantly. Know your options.
I had my ex refuse to sell our house, she wouldnt agree on a price, realtor, terms of sale...nothing....it was ugly I wanted to kill her at times it was so bad. She wouldnt pay the mortgage comapny on the deal I struck with them (I pay 50%, she pay 50% of the monthly payment)
Finally told her in a letter that I was letting the house foreclose after the 3rd month of her playing games. Only then she realized after her parents got involved and told her that you are just screwing yourself over to act like an adult.
We sold the house for EXACTLY what was owed on the note. That was I also avoided captial gains tax on the sale.
Never buy unless you are married, or buy alone........
