i am still searching.. can't seem to find the definitive answer... it does appear that one would need to file in Canada as well...

but, i don't think this is a loophole... that if you base your company in canada that you can escape the infringement claims... since you will most likely be doing with US companies and website visitors, that you would stil be able to sued across the border.
