I had the same problem..
You actually got a few solutions
A. Go BUY a new one, about 60-70.00
B. Toubleshoot over the phone with the tech guy and basically get them to admit its the modem. After you have gotten to that point ask for a supervisor and have them document in your account that a new modem is needed and you are ALLOWED to bring it in for a swap. Then you should be able to take it in for a swap (I went through the same thing)
