Another major factor is that the crap that we all get in our standard mailboxes is paid for by the sender using registered bulk mail permits from the USPS. So, it's their "First Ammendment Right" so long as they are paying their bulk rates to the government and following the guidelines.
Currently, no goverment agencies that I am aware of get a cut from any email marketing.
Makes a big difference on how it is viewed.
