Art. 202.
§ 1. Whoever publicly presents pornographic content in such a way that it may impose their receipt on a person who does not wish to do so, shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to one year.
§ 2. Anyone who presents pornographic content to a minor under the age of 15 or provides him with items of such nature, or distributes pornographic content in such a way as to enable such a minor to become acquainted with it, shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to 2 years.
§ 3. Who for the purpose of dissemination produces, records or imports, stores or possesses or distributes or publicly presents pornographic content involving a minor or pornographic content related to the presentation of violence or the use of an animal, shall be subject to the penalty of deprivation of liberty for a term of between 6 months and 8 years.
§ 4. Whoever records pornographic content involving a minor under the age of 15, shall be subject to the penalty of deprivation of liberty for a term of between one and 10 years.
§ 4a. Whoever imports, stores or possesses pornographic content involving a minor under the age of 15, shall be subject to the penalty of deprivation of liberty for a term of between 3 months and 5 years.
§ 4b. Whoever produces, distributes, presents, stores or possesses pornographic content presenting the created or processed image of a minor participating in sexual activity shall be subject to a fine, the penalty of restriction of liberty or the penalty of deprivation of liberty for up to 2 years.
§ 5. The court may order the forfeiture of tools or other items that were used or were intended to commit the offenses specified in § 1-4b, even if they were not the property of the perpetrator.
