But it is free to the taking. but it's use would be limited outside of the mark/brand.
but the fundamental mistake is trying to sell it to the mark holder.
Comes under the category of knowingly holding it hostage and profiting from others mark.
Now you can't do anything with it as it is now postured for a takeback under WIPO.
Better have your documentation.
It does not cost much to do but it can take a short while to follow the process.
