The feds can go after anyone at anytime they want. Obscenity laws are vague and fluid just for that reason.
Max hardcore is a special case. He is pushing the limits and he knows it. I personally don't like his shit but I do know that what he is doing creates a buffer zone for the rest of us.
And fact is Max got off all the charges brought against him. He always does. It is called precedent. And this can be used as your defense in case you need one so you do not have to spend a year in court like Max did.
