To me there are two kinds of harm.
Type 1 - He says something that hurts/angers someone and potentially what he says causes them difficulty in their life (trouble at work etc). In these cases I think it is a civil matter and should be settled in civil court.
Type 2 - He says something that causes someone to actually attack and physically hurt (or even kill) another person. In this case he needs to be charged. I'm no lawyer so I don't know what charges they would hit him with, but he needs to be arrested and charged with a major crime.
