It's not about the act. Few people actually care that Trump fucked Stormy. The story isn't if it happened, everyone knows it did. However, if he paid her off using campaign funds, that is a felony. Just like Clinton getting a blowjob wasn't illegal and while I don't think the question should have been allowed, he was asked about it and lied under oath which is perjury.
It's often not the act that does it, it's the cover up.
