Look at the date and context of the photo. It's like a publicity still. He's looking at the camera.
And I don't know how much groping you can do when the "victim" is wearing a Kevlar vest.

As I said earlier....the picture isn't the big deal. It was the forced kiss. The picture is just there to help prove her story that he was targeting her with inappropriate behavior, as I'm sure a lot of guys did when she was in her prime.
