La'Tiejira, who is 42, maintains she is not a transgender woman and she provided the federal court with documentation from a state court hearing in Indiana to prove she is and always has been biologically female.
La'Tiejira, who describes herself as an unemployed entrepreneur seeking modeling work, says Facebook left the hate-filled and defamatory posts up for six months, causing her emotional distress and suicidal thoughts.
The lawsuit claims the posts damaged her reputation and impeded her future livelihood. She endured harassment, hate mail and even death threats from the general public and former friends, as a result of Facebook's inaction, according to court documents.
Her attorney, Jimmie L. J. Brown Jr., said one key issue for the court is whether Facebook lives up to the promises it makes to take down hostile and defamatory comments.
Brown argues in court filings that Zuckerberg and his company should be held liable since their failure to remove the posts in a timely manner caused promoters, producers and filmmakers to cease making contact with La'Tiejira. Bullying comments violate the Communications Decency Act, he argued.
The former porn star is seeking $2 million in actual damages and $10 million in punitive damages.
La'Tiejira worked in porn films in Los Angeles in the mid-1990s under the name Lady Paree, according to court documents. On IMDB, a well-known Internet database of movies, she has 14 acting credits, including roles as a voodoo princess in a 1993 video entitled "Immortal Desire" and a film called "The Knocker Room," in which she played herself.
