PCI-DSS rules require encryption for credit card numbers. However, the tokens used in processing that represent an individual could be used to accrue the tokens purchases.

You need a court order for those records to be handed over TO THE COURT encrypted or decrypted -- that is personal property -- not a summons or the subject of a disposition in a civil complaint.
