They were not even in the WH when he did this. This corresponds with the time period Obama was busy putting sanctions on Russia for interference with the elections.
Kushner has violated the Logan act because he is not a govt official and was not authorized by the Obama admin to make any sort of dealings or contacts on behalf of the US govt.
When Bobby Kennedy had back line contact with Russia during the Cuban Missile Crisis he was authorized to do so by the active president.
Trump was not sworn in when Kushner was talking to Russians so he broke the law. Trump would be free to have him talk to Russians now, but he was breaking the law at that point..
He will probably go to jail over this considering all the other Russian shit added on top..
