People are not of equal ability. People of equal ability should have equal opportunities -- not hand outs or set-a-sides.
In a perfect world that is ... I doubt lawful immigrants that are skilled workers go out and commit violent street crimes. Undocumented aliens that work bottom of the barrel jobs and lose the crap jobs they had might decide to become criminals rather than to voluntarily leave the country.
We don't create criminal behavior per se but our actions just further advance the problem.
