Once you're given a deportation order you can't apply for citizenship for a mandatory 10 year penalty period.

He used a loophole to get a greencard, DL and legal SS# to stay in the states while checking in with ICE once a year.

In 2007 He applied for reconsideration because he's married to a U.S. citizen and that case is still pending. Another article with more of their details here.

So technically in 2007 he did apply and it's pending. Once you get a deportation order though you're fucked because America wants you the fuck out and you didn't leave so we're gonna have to force you!
