it's debatable if that is "penalizing an employee"... that employee is simply unable to perform the job... job requires your presence EVERY weekend to lead a seminar, you are unable to do it, so you don't qualify for the job... seems pretty damn simple...
but of course that didn't stop the employee from using some loophole in the labor law from milking an employer out of a nice chunk of change...
