FYI 'intent' is an element of many crimes over a lesser offense. Criminal Fraud requires proof of the element of intent BTW. See the legal definition of 'mens ria'.

In the event this goes to trial, "intent" will be a huge part of it. They will look at intent and damage. The was no bad intention, and there was no damage. If she intended to give these documents to a foreign government, she would go to prison for the rest of her life. But that clearly wasn't her intention. Her only intention here was to do her job. And this investigation has caused more damage than anything else.
The problem is the Republican party cannot seem to beat her on her track record. Her track record is unremarkable and not impressive - name one thing Hillary Clinton did as Secretary of State or in Congress? - but they know they cannot go head to head with her. So instead they attack her.
Best case scenario for the Republican party is this eventually goes to trial, most likely long after this election is over, and Hillary is found guilty and has to pay a fine. Tens of millions of dollars wasted, countless man hours of the FBI and justice department, and in the end nothing changes.
