Juror fell asleep during porn film
A US judge declared a mistrial in an obscenity case after a male juror fell asleep while a porn video was being shown.
The judge in Hamilton County, Cincinnati, was also unhappy that two other jurors averted their eyes while watching Maximum Hardcore Extreme, Vol. 7.
Throwing the case out, Judge Richard Niehaus said: "Justice requires the evidence be reviewed and considered in its entirety.
"The allegedly obscene tape in this case was basically the entire case. In obscenity trials, it is incumbent upon the jury to consider the tape in its entirety as a matter of law."
Shawn Jenkins was charged after Hamilton County Sheriff's Sgt Matthew Guy bought the tape for about £10 in his shop in Corryville, reports the Cincinnati Post.
Sgt Guy said the video, which showed the use of a gynaecological tool known as a speculum, was among the worst he had ever seen.
It was the second mistrial in the case which is now set for a third trial in January. The first mistrial was declared over a technicality.
