Reguardless of the fine print, or people following the regulation of law, or standards in general.. as far as I can see if you Email a list of confirmed addresses, even if you went through the right processes of doing it, you will probably still get a lot of people complaining about spamming.
The reason ad space could be a wiser move is that you don't have to deal with running a risk of some angry mailbox-filled-with-porn surfers who do not recognize your Email as a partner Email sent in relationship to the server they originally subscribed to.
I personally hate signing up somewhere on the net, and then getting hundreds of partner Emails. They are just as bad as any spam to me. The fine print makes it legal, but never does it make it moral.
