Not 100% sure but I don't think it applies to Visa Europe YET. Most Beasty sites are hosted in Europe as it's not illegal in some countries there (didn't say it was legal just NOT illegal). As far as I know it's not illegal in all USA states either, just finding hosting for it in the USA.
