If he can't afford an attorney he will be appointed a public defender. Like Candyflip said, most of them have a huge caseload and they don't have the time or resources for a long, drawn out trial.
A public defender will likely look at the evidence and then encourage Donny to let them try to cut him a deal.
Of course, Donny could always opt to represent himself which would not go well.
