This gets more bizarre.
The earned income credit should only be paid to persons working legally.

No law can be "ex post facto"
No...ex post facto Law shall be passed.
ARTICLE I, SECTION 9, CLAUSE 3
But that is for crimes (and torts).
So, there does have to be a law passed to regulate after the fact tax refunds unearned however gained by either law or executive order.
This is not just an immigration law issue.
Say a corporation depleting oil reserves were to be given a retro-active tax subsidy by administrative law (regulators) or by executive order ... This law I am proposing would prevent that also. It's not anti immigrant it's anti retroactive gain at government/taxpayer expense for any "special" party.
