I think we are going to hear a lot of "I can't breathe" bullshit for the next little while as well.
As numerous physicians have pointed out, if you can say, "I can't breathe" - you can breathe. I have been afflicted with asthma since age 12. I accept their statements.

Technically you are correct but when someone says 'I can't breathe' they are trying to draw attention to the fact that they are severely out of breath or are having some serious trouble breathing. I guess it would be more accurate to say 'Excuse me officer, I'm having some serious trouble breathing. I feel dizzy, light-headed, and severely out of breath. Please help me!' but it's hard to think clearly and be able to correctly articulate everything when you are not getting enough oxygen to your brain. When you become so disoriented, it's much more easier and much more efficient to just say 'I can't breathe!!!'.
