I would think that the conscious users of the software maybe the guilty or just as as there is a lot of grey area here. A gun maker isn't automatically guilty of murder or a gun designer. At what point does the user need to take responsibility? Youtube started similar and possible to send files with icq etc. wondering if there is still a future in the functionality of the software or whether it will eventually be illegal so send a file eg: Not downloaded from an approved site. Not defending the guy that is lawyers job. The site is still hosted so if anything could really be done the site would have been shut down long before an arrest. New names etc isn't stopping them. It has continued to run under new names. Just think the net is getting further censored as a way of prevention rather than an answer to the solution. Nice to think that you can make something and it will be yours without it being ripped off but it is every industry and it is the arts which gets the most attention and prevention. Patents are ripped off daily in plastics industries most likely costing as much as entertainment losses. Problem with most pirated industries the people don't know they have a counterfeit. Deception is the objective to counterfeiting but pirating downloads is finding willing parties that can make any host an accessory to their actions. Not defending just wondering how the big picture will look like.
