That would be Bonnie Rotten who is suing Max over that very scene. She claims there was no model release and that she was never paid, she has also claimed that They had reached an agreement whereby Max would not use the scene then he did anyway....

The courts will apparently settle it....although the idea that the scene would be played for a judge should likely cause some consternation for Max
