This is the second time it has happened. In 1999 it was cancelled and then in 2003 it was reinstated by a Judge on appeal.

They still have a common law TM for it - it just won't have federal protection of a famous mark. It really just means they would have a little more work to do in a legal sense to enforce it.

It doesn't mean they are forced to charge their name or even that they couldn't protect it.
