I heard about this through the http://blog.teamtreehouse.com/ site on their weekly podcast. The game has been around for several months.

Copyright, I would say yes.

The game is a clone. Doom was converted into flash (the first episode which is freeware and the music was copyright so it is not included).
For the sake of age, being a classic, I give it a pass however.

Clones are made all the time that are just copying functionality, Linux (completely free) is essentially a Unix clone. The code isn't the same but provides (much more now) the same functionality.

Even as far back as dreamcast friends of mine would have a DVD disc that had every Nintendo game ever made on it.
Funny how I would beg my mom when I was 6-7 to get me a shitty Nintendo game I had no idea about for $50-70, she declined me thank god!
Playing some of the old games I can't believe how much they sold for considering how low value they are. Super Mario 2 and 3 are good games, and worth the price, not many games were though.
