Wells Fargo et. al. sold off the mortgage to Fannie Mae or Freddie Mac. Unless ALL of the holders of interest in the MBS sue they can't come to court. See Landmark Nat?l Bank v. Kesler, 2009 Kan. LEXIS 834 (Aug 28, 2009)--- Only the real party in interest can come to court.
I know I give you a lot of grief on GFY, but your aunt does have a case here. I have yet to see a mortgage company not violate the National Mortgage Settlement Agreement. Post something here and I'll get back with you. I have several people i the same boat. More suits help all.
