Its really stupid and to me a waste beyond belief. But.
She got close enough to spit on his face and that is not good. She also as they say Licked his shield which is what they are most likely using against her. The kiss would he hard to win in court but the lick is a clear attempt to transfer bodily fluids and that is usually deemed as hazardous.
Stupid over all on both parts.
