That struck me also. It was actually an interesting article, and I can see how it's possible that by using the letter of contract law, the original author got screwed.
Meanwhile, everyone is getting all caught up in the silly argument of whether the theory of the premise was correct or not....
Although, come to think of it, I guess it's more fun to argue about that, then to simply comment about an interesting contractual dispute.
