You usually get into less trouble and it's less expensive if you actually back over and kill the person you just ran over. If they live, it's a legal mess and very expensive. If they die, it's faster and costs less to settle. Jail time usually depends on the class of person you killed or if you have the money to pay off the family or not.
For example, you're drunk driving like a dickhead and kill someone. Lets say the guy killed is a factory worker. Give his family $1500 - $30,000 USD, and they let it go. Price usually depends on the earnings of the one killed, how poor or wealthy the family is, and if the driver / killer is a local or foreigner.
There are always exceptions, but that is generally how it plays out unless it's a media spectacle.
