No Dan and I are saying the same thing. I dont think anyone is going to be arrested in Cali for not using condoms. CalOSHA regs only provide for fines (and barring operation of the company within California) not arrest.
Measure B in LA provided for criminal charges but B isnt being enforced at this time.
Once the new California regs are approved by Fed-OSHA it will make it easy for any other state to adopt those regs and enforce condoms/barrier protection in that state.
For instance, if Nevada and Florida wanted to they could adopt the same regs that California uses and beging enforcement and levy fines against those companies that are shooting in their respective state(s).
I suspect that this will happen. So eventually we will have a national condom law. Its an easy way to regulate porn. Much easier than trying to challenge it on a First Amendment/criminal basis.
The industry can move out of California but thats not a guarantee that at some point condoms will not be required in those states where producers relocate. Its not time to panic but just be aware that just because you're not in Cali, that doesnt mean condoms wont be the law where you are.
And if the idea of moving out of the US is intriguing that might be a tough sell as well.
I am in Budapest for the European Summit and of one of my US based producers is here trying to shoot US male talent with EU girls. He was told by the agent here that his male talent needed 3 months of clean tests to show as well as an HIV test from two different testing facilities in Budapest. And if thats not bad enough one female talent refused to work with any US based male talent because of the recent HIV situation in LA.
