And since you don't get it Tom, the entire case hinged on a single piece of evidence (with respect to the Murder 2 charge)... and thats whether or not what was said on the 911 call could convince a jury that he was acting of ill will, hatred, spite etc AND of a depraved mind. Thats why no charges were filed. There was no evidence to prove that beyond a reasonable doubt.
All you have to do is listen to the 311 call and hear what is basically a dopey dipshit, acting very calmly and calling in suspicious activity as he'd done 45 times or so before.
The detectives i believe were also of the opinion that he should have identified himself, should have talked to him etc. and that was the basis for their feelings on the situation. BUT that all has nothing to do with proving what Zimmerman was thinking when he was attacked (as detectives admittedly believed he was) BEYOND A REASONABLE DOUBT in a court of law.... which is why charges weren't filed. The detectives felt manslaughter was possible, but also admitted Zimmerman was credible and his story believable... which creates a problem when it comes to pressing charges.
