Records show that a Leonard Raynard Murphy was arrested in July, 2009, on charges of aggravated battery with a firearm and shooting into an occupied vehicle.
The chief said Daytona Beach Police wanted to arrest Mr. Murphy after he shot Mr. Gatlin - the State Attorney's office said otherwise.
"I've seen cases where we believed we had probable cause to arrest," he said, "and they said, 'Yeah, uh, we're not going to prosecute.'"
