Hope you get better and don't have any long term issues as a result. If he just got out then he is almost surely still on probation. Doesn't matter who started it at that point, all things considered, but if he attacked you at a party then there are going to be witnesses and he stands to get supremely reamed being jammed back into the system.
Forget personal retaliation. Get Johnny Law to take care of it. That is what you pay your taxes to deal with.
