If this were physical goods many of the people in our industry would be subject to arrest for possession of stolen property and the traffic brokers would be found guilty of operating a fencing operation. Food for thought.
Sure you can argue that the DMCA makes user uploads legal and so it's not the same. However the DMCA does NOT protect tubes who are uploading stolen content themselves or paying others to do so. Nor does it cover willful negligence and conspiracy in regards to repeat infringer policies. Not only in U.S. law but the laws of most other nations as well.
