I don't understand why people aren't suing or why sponsors aren't getting together as a group and pooling resources to sue. You could conceivably take everything they own including all their tubes. The payoff would potentially be huge.
You would think the evidence shown here and in the past would be enough for at least a supeana for more information and the start of a very strong discovery process. And they would almost be sure to settle because once certain information gets out or a judge rules against them they are totally fucked. There would be avalanche of lawsuits from people looking to get a piece of them and every other tube like theirs.
To me these guys seem like walking targets which say "sue me" and "free money".
