I have spent the past 30 minutes analyzing the first minute of this video.
Conclusion: He didn't know it was a police officer yelling at him and freaked out.
We see the white truck pull into the drive and then the cop pulls up behind them. He opens the truck's door, likely not knowing the cop is back there.
The cop then yells:
"Hands up. Hands up, Ernie! Don't you move! Ernie, don't you move I will shoot you!"
All of that is said before Ernie exits the car. He doesn't know who is yelling at him. He doesn't know who is threatening to shoot him.
He is likely in a state of panic as he exits the truck and thus does not respond well to the officer's orders and instead dances around.
He is then shot.
