Conspiring to commit a crime is no different. Just because you fail in the actual act does not mean you should not face the consequences.
Lets say you plan to blow up a building. You spend time planning and detailing your crime. You procure some of the items needed to create your bomb. Then the police catch you before you put the plan into action. Should you walk free ?
