why should it matter the origin of the file, who originally stole it doesn't matter
your actions as a webmaster are knowingly publishing a video on your site, it is not a random user publishing the video on your site, it doesn't matter that someone uploaded it somewhere else first and now you are publishing their upload, you are now choosing to put something directly on your site by your actions.... pretty hard to hide behind dmca for that
