the trick here is that they will have nothing to give up as logs never touch the harddrive on their end plus being offshore definitely gives breathing room.
I don't think you realize just exactly what vpn's are being used for, and it's definitely not just for torrenting, although over the years that's exactly their selling point, but vpn is also used for much more serious activities and the only time someone was caught was when they mistakenly thought they were using a vpn, when in fact they've been in bed with the federales.
but for arguments sake, let's consider a sleezy porn company who can't make money anymore so they go after downloaders using vpn + tor. Do you know how serious the DOJ would take them let alone even get a subopoena on the vpn providers who are offshore? Let alone when they don't have the infrastructure setup to log activities as evidence? What happens when the vpn ip is shared by hundreds, you simply have no case. Sure, it might not be impossible to prosecute but the cost/benefit ratio is not worth it, they rather go after unsuspecting Americans who doesn't even know what an IP is (which btw is a lot considering most americans can't even find their country on the map).
