Yep,
Send his hosting, and Him a C&D Letter.
Make sure he sees, you CC to his hosting company.
List the Whois info of the site.
Include a link to your site, and your whois info, and
a copy of your proof, that the content is yours, helps..
I.E. Pic of you holding your DL infront of the computer screen with the web page in question in the background...
