This is why I am fine with us holding potential terrorists in Guantanamo Bay. You might say it's "un-American", but the US Constitution does not apply to Cuba or our forces there... Or our military forces around the world. You can also say it's "un-American" to be using drones to kill suspected terrorists in other counties, and you can even say it's "un-American" for us to send a Navy SEAL Team into a foreign country to kill Bin Laden. I sleep good at night really.
