No, the definition of immigration is obtaining permanent residency form another country. Just because you illegally crossed the border at age 75 and died 5 years later does not make you permanent resident. Every illegal is subject to deportation, thus he/she does not have immigrant status. He is out of status and once deported person becomes blacklisted for 5 or 10 (?) years from entering into US.
Look at it as criminal who's been convicted of crime yet was able to hide out for 20 years. Does it make him innocent?
