You don't have to pay included gratuity, it is supposed to be included for your convenience. If you ask them to remove it they do. I have done it before. Also, they should have just left cash on the table for the exact amount minus gratuity and left.
If they held me against my will I would have started beating on whoever got in my way on the way to the door. I am trained in martial arts, I would have skillfully knocked a few on their asses and left.
