or Private will pay BP to settle out of court, BP loses his sites, but gets an out(as he claimed they weren't making much anyways). Private then sets an example they can use as leverage against others that are doing the same thing, without ever letting a court decide the legality of embedding. Since BP is seen as a "baller" anyone else they go after will assume he couldnt fight his way out and neither can they, and will also settle.

just remember folks, not all lawsuits are real, some are just posturing with no intent to really do much. and this industry is well known for doing it.
