If it wasn't for the disease, spitting isn't that much worse than what many ppl here call "trolling".
Also isn't he more likely to get infected from the blood from that beating than one spit?
Well we may not know the whole story but from what can be seen they both deserved some punishment, though 2 years sounds too much, and if he does get an infection that's another thing.
