Not everyone who has kids and is backdated on child support is backdated cos they're a loser and don't want to pay. With today's economic climate it's harder than ever to get and keep a job, so this kind of thing is happening more and more often I'm sure.

tell her to contact an attorney. she is just as much to blame as him going to jail then anyone else if she doesnt. im sure he will agree to split the costs of the attorney or even pay for it.
in my prenup, i had a contractual agreement on alimony/child support stating that whatever the amount the court finds, she will have to repay to me 99.9% as a penalty for breaking the marriage agreement, as well a fine and lawyer fees. Asked a shaddy attorney friend of mine to take a look and said its binding, but would cost her thousands to defend as it reads I agreed to marriage in return for money from her upon dissolution, regardless of who filed.
