your saying the only way the host could be protected safe harbor provision was to
destroy my backup even though they could remove infringing access by simply changing the password and notify me.
the people using megaupload as an onliine backup with zero distribution (keeping the link private) are within the bounds of fair use and are therefore not an example of infringing material.
