While I agree that many cases of guys getting a women drunk to get in her pants can be fucked up, I think something like this is going to open a flood gate of women saying I was drunk, throw the bastard in Jail!
Then there are the women that hang around till 2 am hoping to have the last guy there with the beer goggle effect!

I don't think that's what they mean by incapacitated.
I believe they're referring to when someone gets so drunk they pass out, or are given Rophynol and aren't able to remain awake.
If they meant anyone who was drunk... that would be a bit much.
